Terms of Service

Freediver · Version 2026-07-10 · Effective 10 July 2026

Template notice. These are general, plain-language terms assembled from common, widely-recognized consumer-app conventions and the Apple App Store and Google Play developer requirements. They are a starting point, not legal advice. Before public launch, have them reviewed by a qualified lawyer and fill in the bracketed placeholders: the provider [COMPANY_LEGAL_NAME], contact [CONTACT_EMAIL], and governing law / venue [GOVERNING_JURISDICTION].

These Terms of Service ("Terms") are an agreement between you and [COMPANY_LEGAL_NAME] ("Freediver", "we", "us") governing your use of the Freediver app and service. By creating an account or using the app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Freediver.

1. Eligibility

You must be at least 16 years old to use Freediver and you must be able to form a binding contract. By using the app you confirm that you meet these requirements.

2. Your account

You are responsible for your account and for keeping your login credentials secure. Sign-in is handled through our authentication provider. Tell us promptly if you suspect unauthorized use. You are responsible for activity that happens under your account.

3. What Freediver is — and a critical safety notice

Freediving is dangerous and can cause injury or death. Freediver is a logbook and planning tool only. It is not a safety device, a dive computer, medical or training advice, or a substitute for proper training, a certified instructor, a trained buddy, and safe diving practices. Never dive alone, never dive beyond your training, and always follow the guidance of a qualified freediving agency and instructor.

Any numbers, ranges, statistics, or suggestions in the app are informational only and may be inaccurate. You are solely responsible for your own safety and your diving decisions. Do not rely on the app for any safety-critical purpose.

4. Your content

You keep ownership of the content you create — your logs, notes, sites, and messages ("Your Content"). You grant us a limited licence to host, store, process, and display Your Content solely to operate the service for you and the people you share it with. You are responsible for Your Content and confirm you have the rights to it.

5. Acceptable use and community rules

Freediver includes social features (friends and messaging). When you interact with others, you agree not to:

You can block any user and report any message. We may review reported content, and we may remove content or suspend or terminate accounts that violate these Terms, with notice where practicable.

6. Privacy

Our Privacy Policy explains how we handle your personal data and is part of these Terms.

7. Third-party services and content

Freediver relies on third-party providers (such as map tiles, authentication, and hosting) and may let you import files from dive computers. Their content and services are governed by their own terms, and we are not responsible for them.

8. Changes to the service

Freediver is under active development. We may add, change, or remove features, and we may update these Terms. When a change is material we will update the version and effective date above and, where appropriate, ask you to review or re-accept. Continued use after an update means you accept the revised Terms.

9. Termination

You may stop using Freediver and delete your account at any time from within the app. We may suspend or terminate your access if you breach these Terms or to protect the service or its users. Provisions that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will survive.

10. Disclaimers

To the fullest extent permitted by law, Freediver is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any data or calculation is accurate. See the safety notice in Section 3.

11. Limitation of liability

To the fullest extent permitted by law, Freediver and its provider will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, or for any personal injury or death arising from your use of — or inability to use — the service or from your diving activities. Where liability cannot be excluded, it is limited to the amount you paid us for the service in the twelve months before the claim, or the minimum the law allows. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to indemnify and hold harmless Freediver and its provider from claims arising out of your Content, your use of the service, or your violation of these Terms or of others' rights, to the extent permitted by law.

13. Governing law and disputes

These Terms are governed by the laws of [GOVERNING_JURISDICTION], without regard to conflict-of-laws rules, and disputes are subject to the courts of that jurisdiction, except where mandatory local consumer-protection law gives you other rights.
